General Liability:
Are volunteers covered for
their actions while working on behalf of the county?
Yes, bodily injury or property damage caused by a volunteer
would be covered.
Is the county airport covered
by TAC general liability policy?
Yes, the county airport is covered for premises liability
only. However, most counties with airport operations
choose to purchase commercial airport liability coverage,
which is a more appropriate alternative.
Are county employees in the
medical professions covered for rendering of medical
services, by the TAC general liability policy?
Yes, except employees working in hospitals or nursing homes.
Should the county report mobile
equipment, such as maintainers, backhoes, etc. to TAC
if they only require liability coverage?
No, it is not necessary. All mobile equipment is automatically
covered by TAC general liability.
If the county takes possession
of vacant land should it be reported to TAC?
No, it is not necessary to report ownership of vacant
land. All county owned property is automatically covered
under the TAC general liability.
Why are you paying the medical
bills when the county is not liable?
Medical payments up to $1000 limit on the General Liability is no fault coverage.
You do not have to be at fault or negligent for the
medical payments to come into play.
Why is that not covered, I thought
everything was covered?
Check your policy to see what the exclusions are. Policies
do not cover every exposure because a policy that broad
would be too expensive for anyone to afford.
Auto Liability/Auto Physical Damage:
Are constables and other county employees covered
by the TAC Auto policy when they are driving their personally
owned cars on county business?
No, vehicles not owned by the county are not covered.
Anyone who drives their own vehicle on county business
should be required to purchase personal auto coverage
for their vehicle.
EXCEPT: TAC does offer an endorsement, for an additional cost, that provides
auto liability coverage for Constables, Sheriffs and their Deputies but only
while performing official duties on behalf of the county. Contact your TAC
service representative for information
Can we add vehicles not owned
by the county to the county's to the Auto policy?
No, such vehicles should not be reported to TAC for
Auto coverage. Only vehicles titled in the name of the
county or on long term commercial lease to the county
are eligible for coverage under the TAC Auto Liability
or TAC Auto Physical Damage policies.
EXCEPT: Personally owned vehicles of Constables, Sheriffs and
their Deputies that have been added under the optional TAC Auto
liability endorsement that is available at an additional cost.

If a vehicle pulling a trailer
is scheduled on the county's Auto policy, but the trailer
is not, will the Auto Liability still cover the trailer?
Yes, if the loaded trailer is less than 1500 pounds
GVW. Larger trailers should be scheduled on the TAC
Auto Liability policy.
Do county employees who drive
their own cars for county business purposes need to
be added to the driver list?
No, only frequent drivers of county owned/leased vehicles
need to be on the driver's list.
What information does TAC need
to add a driver?
Driver's name as it appears on their license, date of
birth and Texas driver's license number.
How do we know which vehicles
need to have Auto Physical Damage coverage?
Most counties do not cover vehicles over 5 years old.
However, vehicles reported to TAC will be covered no
matter the age.
Is the equipment permanently
installed in a vehicle, such as a Sheriff's patrol car
or an ambulance, covered under the county's auto physical
damage?
Yes, if the increased cost of the equipment is added
to the base cost new of the vehicle, it will be covered.
Is it necessary to report vehicles
as soon as they are purchased?
It is best to report vehicles to TAC as soon as they
are purchased. Under Auto Physical Damage all vehicles
must be reported to TAC within 30 days of purchase.
However, under Auto Liability any vehicle titled in
the name of the county or on long term commercial lease
to the county is covered even if it is not reported
mid-year, but it needs to be reported with the next
renewal application.
What information does TAC need
to add a vehicle?
Year, make, model, vehicle identification number and
department using vehicle. If auto physical damage/full
coverage is required then the cost new should also be
reported.

Public Officials Liability:
Are county officials covered
by the TAC public officials liability when they are
serving on a board of directors not governed or appointed
by the county?
No, service on boards or commissions is only covered
if such units are operating under the jurisdiction of
the county.
Do we need the District Attorney's
endorsement?
District Attorney's endorsement is an optional coverage
available to those counties who wish to purchase it.
Do we need the District Judge's
endorsement?
District Judge's endorsement is an optional coverage
available to those counties who wish to purchase it.
Are volunteers covered under
the TAC public officials' policy?
Yes, volunteers are covered for wrongful acts which
occur in the course and scope of their duties for the
county.
What is the proper coverage
for addressing employment claims against the Sheriff,
such as wrongful termination or discrimination?
All employment related claims are covered by TAC's public
officials' liability. These are excluded under law enforcement
liability.
Does TAC's public officials'
liability respond to an EEOC charge?
Yes, it should be submitted to the TAC Claims Department
with a request for pre-claims assistance.
Law Enforcement Liability:
Are members of a Sheriff's posse
or other law enforcement volunteers, covered by the
TAC law enforcement liability policy?
Yes, volunteers working in the course and scope of their
law enforcement duties for the county would be covered.
Are the actions of drug dogs
and horses covered by the TAC law enforcement policy?
Yes, as long as the animals are involved in the course
and scope of a law enforcement activity for the county.
Animal Mortality, Theft & Loss of Use coverage for law enforcement dogs and horses can be purchased through TAC Property program.
Is a law enforcement officer
employed by the county but temporarily working for another
jurisdiction covered by the TAC law enforcement liability
policy?
Yes, as long as the Sheriff of the county that employs the officer
has assigned the officer to this temporary duty.
Are deputies covered under the law enforcement coverage when they are working at off-duty employment?
Only if the off-duty employment has been authorized/approved by the Sheriff and the action developing the claim was performed on behalf of the Sheriff's department.
Should constables and juvenile
probation officers be reported to TAC for coverage under
the county's law enforcement liability policy?
Yes.
Does the full-time employee
rate apply to part-time staff under law enforcement
liability? No, on the application, separately
for each classification category, indicate the number
of full-time staff and then the number of part-time
staff noting either the number of hours worked by each
or a percentage of full-time worked by each (75%, 50%,
or 25%).
Do we need the District Judge's
endorsement?
District Judge's endorsement is an optional coverage
available for purchase by counties reporting juvenile probation officers on their application.
