Counties Have New Building Code Authority Under HB 2833

House Bill 2833 by Marquez/Shapleigh passed during the 81st Legislative Session. The new law grants 253 counties limited, permissive authority to impose building codes in unincorporated areas.

Several counties already have adopted building codes under the new law, but many counties need more details before deciding whether to take action under HB 2833.

The Conference of Urban Counties (CUC) prepared questions and answers on the bill, along with sample resolutions and Tarrant County’s sample notice forms. CUC Executive Director Donald Lee recently made a presentation on HB 2833 and handed out the documents at the October statewide conference of the County Judges and Commissioners Association of Texas in Corpus Christi.

The new law applies to all counties except Loving County, because it started out as a bracketed local bill for El Paso County and morphed during the session to include other counties. Because it began as a bracketed bill, some type of population bracket had to be in the final version. Hence, the new law applies to all counties with more than 100 population, leaving out only Loving County.
