Overview

The Spring Education Session of the Texas Judicial Academy will give you an excellent opportunity to learn from and visit with judges from across the state and to discuss a wide range of topics that affect your judicial duties. The County Judges Education Advisory Committee has designed a curriculum that will not only constitute an in-depth review of core topics, but will also address short topics of interest and introduce you to several new, cutting-edge programs being used successfully in other jurisdictions.

Reimbursement

This program is partially funded by a Judicial & Court Personnel Training Fund grant administered by the Texas Court of Criminal Appeals. In accordance with the grant guidelines, judges may be reimbursed up to $750 total per fiscal year for attending the Fall Judicial Education Session, the Spring Judicial Education Session or the Texas College of Probate Judges.

All travel reservations made through third-party vendors (Hotels.com, Expedia.com, Booking.com, etc.) cannot be reimbursed. For more information on reimbursement, please call Michele Mund at (800) 456-5974.

Reimbursements must be submitted to TAC within 60 days of the event. Any request received after 60 days will not be reimbursed.

Reimbursement may be provided for county judges only.

The registration fee for this conference is $125.

Registration fees are voluntary and used for expenses that are unallowable or are insufficiently covered by the Judicial & Court Personnel Training Fund grant. These include speaker fees, materials, meals, and social activities. Fees are deposited in a fund held for county judge education within the general revenue funds of the Texas Association of Counties.

The ability of judges to exercise discretion in the courtroom is a central tenant to justice and fairness in Texas.  This session will review areas where the judge can exercise discretion and guidance on when it is appropriate.

Indigent Defense

Introduction to the right to counsel for those charged with crimes who are unable to afford to hire their own attorney. This session will include an overview of the Texas Indigent Defense Commission’s grant and monitoring programs, the Texas Fair Defense Act, and key requirements of compliance for county judges in regard to indigent defendants.

Ethical Dilemmas for Judges

Evidence: Hearsay

County Judges are frequently faced with evidentiary decisions, many of which involve hearsay rules.  Judges will acquire information related to hearsay objections to assist them in distinguishing proper evidence, objections, and analysis and to determine admission and weight of this evidence.

This session will discuss misdemeanor crimes and the consequences of conviction for those crimes.  DWI cases are prevalent in County Court and the discussion will focus on those cases and various options available in sentencing.

Juvenile Law Overview

Pesky Problems in Probate

While the area of probate and estates is generally a landmine for the unwary, there are particular “pesky” issues which seem to crop up regularly.

Heirships and Administrations

A court must make a formal determination of a decedent’s heirs in three main situations. First, the decedent died intestate and no estate administration is necessary. Second, as part of a dependent administration to ascertain heirs. Third, as part of an independent administration to determine heirs both for purposes of ascertaining the people who must consent to the independent administration as well as the heirs who will receive the property. This presentation will discuss the heirship determination procedure as well as cover the basics of how heirs are determined under Texas law.
