Attorney General Opinions

GA-1044: Whether justice courts are authorized to charge a fee for filing a petition to apply for an occupational driver's license. (RQ-1148-GASummary: House Bill 438 does not eliminate a court's authority to charge a fee for filing a petition to apply for an occupational driver's license under section 521.242 of the Transportation Code. Section 118.122 of the Local Government Code authorizes justice courts to charge a fee for filing such a petition.

GA-1046: When district courts should begin collecting the new fees for electronic filing under House Bill 2302 and Senate Bill 390.  (RQ-1151-GASummary: The fee amounts mandated by Government Code section 51.851 apply to fees that became payable on or after September 1, 2013.

GA-1047: Whether Education Code section 11.301 authorizes the citizens of Harris County to use repealed chapter 18 of the Education Code to increase the county equalization tax (RQ-1152-GASummary: A court would likely conclude that section 11.301 and former chapter 18 of the Education Code do not authorize a countywide school district to hold a petition-initiated election to increase the county equalization tax.
