    “We need a county fire marshal. How do we create the position and what are the required qualifications?”

    How does a county establish the county fire marshal role and responsibilities?

    Under Local Government Code §352.011, the commissioners court may create the county fire marshal role and provide office facilities, equipment, transportation, assistants, and professional services. The term of a county fire marshal should not exceed two years. The position requires the person to take the oath prescribed by the Texas Constitution and post a bond in an amount specified by the commissioners court. The county fire marshal may not be directly or indirectly interested in the sale of fire-fighting equipment and may not be engaged in any type of fire insurance business (Local Government Code § 352.012).
